Web Hosting Payment Policies and Associated Fees

First month payment plus setup fees are due upon account setup. Payment is due on or before the payment due date specified on the invoice. All accounts that are past due by more than 10 working days from due date are subject to 10% late fee and interruption of services without further notice. With all disconnections, a $50.00 reinstatement fee will apply to reactivate the services. Overdue accounts may be terminated or suspended at TOP STOCK’s discretion. All NSF checks will be charged $25.00 and the account may be suspended or closed at TOP STOCK’s discretion.

TOP STOCK may require all delinquent balances to be paid prior to account reactivation, including and applicable reinstatement fees. In the event of collections the account holder agrees to pay all attorney fees, court costs, and/or all collection fees with respect to the recovery of any past due balance. 

TOP STOCK reserves the right to issue special invoices when the balance due will be more than $200 over the base monthly service fee.

TOP STOCK reserves the right to change or alter its web hosting rates at any time. Web hosting rates will be listed on TOP STOCK web site and the account holder agrees to these rates and any changes made.

TOP STOCK may terminate service to the subscriber at any time, without notice, for violation of this agreement. TOP STOCK will not be liable for any damages or harm to the account holder resulting from such termination.

The account holder may terminate their account at any time. The request to terminate the account must be in writing. The account holder may send cancellation request via an email message to info@alldigitall.com. Nonpayment is NOT notice of intent to terminate the account, and the account holder will be held responsible for all account fees and charges.

Accounts which have balances outstanding shall be deemed to be in default and subject to termination of service. Customer shall be responsible for all costs of collection, including reasonable attorney’s fees and court costs, in event of a default for nonpayment of any amounts due TOP STOCK.

Delinquent Accounts

TOP STOCK is not set up to pursue slow paying accounts and expects all accounts to be kept up-to-date.  As a result of client adherence to this policy we then pass on our operating cost savings to our customers in the form of lower rates. Invoices are issued on or about the 20th of each month. Payment is due upon receipt of invoice, and becomes overdue after 10 working days have lapsed from the date an invoice is presented for payment via email.

If payment has not been made by the 15th of the month following and we have not made other arrangements with you, your Internet site will be suspended until payment is made. ALL SUSPENDED ACCOUNTS WILL INCUR A $50 REINSTATEMENT FEE. Contact us immediately if there are any questions about items detailed on the invoice or should any nonpayment issues arise. Any disputes over charges must be in writing and received by us within 7 days after having lapsed from the date postmarked on the envelope or you will waive any objection.

Time is of the essence for payment. At our option, interest charges may be added to any past due amounts at the lower of 1.5% per month or the maximum rate allowed by law, prorated for each day payment is past due or a flat 10% late fee. It is TOP STOCK’s decision which will be applied. Acceptance of late or partial payments (even if marked “Paid in Full” or with other restrictions) shall not waive any of our rights to collect the full amount of your TOP STOCK charges. We will assess an additional $25 fee for any check returned for nonpayment. Notice of any disputes over charges must be in writing and received by us within 7 days after having lapsed from the date postmarked on the envelope or you will waive any objection. You agree to reimburse us for reasonable attorney’s fees and any other costs associated with collecting delinquent or dishonored payments.

Important note regarding design work completed on web sites that are hosted on servers that TOP STOCK does not have administration level control of:

At any time after a TOP STOCK client attains in arrears status for non-payment of outstanding invoices for any and all production work completed on a web site that is being hosted on servers that TOP STOCK does not have administrator level control of, but that are under the administrative control of a client with which TOP STOCK has a web design contract, any changes to User IDs and Passwords necessary to gain access to the site server which thus prevents TOP STOCK from accessing the servers to which TOP STOCK has posted clients’ web pages in good faith of payment will thus immediately constitute a violation of copyright. Access to servers must be provided at all times to allow TOP STOCK to protect its copyrights in any way TOP STOCK deems prudent and appropriate.
